What the Supreme Court has to say about expert testimony & scientific information.

In a landmark decision the US Supreme Court has established specific guidelines as to what information can be admitted as scientific information and if the witness would be qualified to testify regarding that information. Any "expert" "expert testimony" or their "research" that does not meet these guidelines are prohibited in any trial.

 

  • l Whether the proffered knowledge can be or has been tested empirically, i.e., whether it is "falsifiable."
     
  • l Whether the theory or technique has been subjected to peer review and publication;
     
  • l Whether, in the case of a particularly scientific technique, the method contains a high known or potential rate of error;
     
  • l Whether the testing / research methodology is generally accepted within the scientific community.
